Yes there are – in most cases you have 3 years from the date of the accident to make a claim. If the accident happened when you were less than 18 years of age, then you have 3 years from your 18th birthday to begin your claim. If you are suffering from an industrial disease, you usually have 3 years from the “date of knowledge” i.e. the date on which it was confirmed to you that your disease was caused by your working conditions.

It often becomes more difficult to provide evidence in support of your claim as time goes by. Your claim is therefore much more likely to be successful if you make it sooner rather than later.

We recover our costs from the responsible party's insurers and we deal with most cases on a No Win No Fee basis, so you will not usually be asked to pay anything to us to pursue your claim – win or lose.

Provided that we receive your full co-operation throughout the claim, and that you are not awarded less at a court hearing than the insurers had offered to settle, you will receive your compensation in full with no deductions for our services.

If your injury was sustained in a Road Traffic Accident where the responsible driver cannot be traced then your claim will be dealt with by the Motor Insurers Bureau (MIB) and not all costs can be recovered from the MIB, so a fee may be charged if the claim succeeds.

The amount of compensation received varies widely depending on the type of injury sustained, the likely recovery time, the type or amount of treatment required, the impact of the injury on your lifestyle, any pre-existing conditions and any complications arising from the injury.

However, in some cases, legal proceedings are necessary in order to ensure that you receive the maximum amount of compensation for your claim. If it becomes necessary to issue proceedings then we will deal with all the paperwork and preparation and will clearly explain the procedure to you.

It is difficult to give guidelines on how long cases generally take. If liability is admitted and your injuries were not too serious your claim should be concluded within a few months. The more seriously you were injured, the longer your case is likely to take. If liability is disputed or we cannot agree a settlement of your case for any reason, we may have to take your case to court, which will often cause a delay.

Remember that in some cases, it may not be in your best interests to settle your claim too quickly.

However long your case takes, you will be given regular updates on progress.

There are things which you can do to minimize delays. If you receive a letter or a call from us asking to provide information or documents please try to get those documents to us as quickly as you can. Keep a diary of important events like medical appointments so that you can provide us with that information quickly and easily. Keep receipts for any expenses or losses you have suffered and send those to us promptly. Always keep copies of any documents you send to us.
